What factors impact the settlement amount of your case?

When we get a settlement offer from an insurance company, we’re going to talk to the client about that. And when we’re valuing a case and telling a client whether we think an offer is fair or not, there are a lot of things that go into play. The amount of the medical bills is one, whether there’s lost wages, whether there’s a loss of earning capacity, the length of treatment, the seriousness of the injuries. Was it soft tissue? Was there a broken bone? Did it require surgery? Is the plaintiff able to get back to baseline, meaning they’re 100% better, or are there going to be lingering issues? The length of time it took the plaintiff to get better or the length of time the plaintiff’s going to be dealing with this– Is it for the rest of their life, the next few years? Those are all things that we need to consider when arriving at what a a good settlement value would be also things that we need to consider if we’re going to recommend to the client that this is just not an offer that’s acceptable and we need to take the next step and file a lawsuit and take it to trial.
